Court Hearing in Sierra Club Case Held Last Week

The hearing in the Sierra Club et al. v. Scott Pruitt case was held late last week in Federal District Court in Oakland, CA.  Judge Jeremy White presided, heard arguments from both the Justice Department and plaintiffs’ counsel on whether EPA had exceeded its statutory authority in extending the compliance deadline to December 12, 2018, and then posed a series of questions.  CPA counsel attended in person and reported back that those that filed amicus briefs – CPA, KCMA/IWPA/RILA and AHFA - were not asked to speak in support of their positions.  The Judge did note, however, that he was sympathetic to concerns from amici and would take them into consideration. 

Ultimately, the judge did not issue a tentative ruling.  CPA will track the docket closely and share the final decision with members when it is issued, which could come within the next two months.  More Info: Jackson Morrill
