EPA to Publish Labeling Amendment Tuesday

The EPA will publish tomorrow in the Federal Register a proposed Direct Final Rule removing the labeling prohibition, Section 770.45(f), in its entirety from TSCA Title VI.  Should the proposed rule go through without negative comment, composite wood products and finished goods that meet the required emissions standards could be voluntarily labeled as compliant once compliance is achieved after the Direct Final Rule’s effective date.

If there are no adverse comments to the Direct Final Rule, the rule will automatically go into effect 45 days after publication.  As was done with the proposed change to the compliance date, EPA will also publish tomorrow a notice of proposed rulemaking that will be used in the event an adverse comment is made on the proposed Direct Final Rule.  CPA will provide a link for comments on the proposed amendment in the next edition of @the edge.  See Prepublication Draft and EPA.  More Info: Jackson Morrill
