CPA Submits Comments on Proposed “Once In, Always In” Final Rule

CPA joined a coalition of industry associations to submit comments on EPA’s proposed “Once In, Always In” final rule (“Reclassification of Major Sources as Area Sources under Section 112 of the Clean Air Act”). The proposed rule would amend a regulation put in place by EPA in 2020 that allowed facilities to reclassify from a “major source” to an “area source” if hazardous air pollutant emissions remained below certain thresholds. The proposed rule reinforces the principles of the pre-2018 “Once In, Always In” policy, which prevents reclassifications. See Proposed Rule and Industry Coalition Comments.
